Summary Note The authors "set out to examine the ways in which the world of work is changing under the pressures of globalisation, and the role law plays both in constructing and responding to those changes. Ever since the early 1990s, a fundamental shift in the nature of the law regulating work has been observable in Australia. The unique system of industrial awards, the product of a centralised system of conciliation and arbitration, has progressively been abandoned in favour of greater regulation through enterprise bargaining. An important dimension of this development has been the individualisation of bargaining, which has called into question traditional assumptions regarding the collective nature of the participants within the regulatory scheme and, indeed, of the scheme itself.... [T]he book's concerns are somewhat broader than those traditionally encompassed in employment, labour and industrial relations law. The major themes of contract and cooperation, equality and diversity, and freedom of association provide the foundation for the coherent analysis and critique of the cases and legislation that together comprise the law of work." (p. viii).
